Child custody and juvenile court laws are entirely state-specific. You should consult with an attorney who practices in that state for guidance. If so, that means that the laws of that other state, rather than Oregon, will control. The other big issue here is that, if the children no longer live in Oregon, then I expect that this action is taking place in the state where they live. You may be able to file a motion to intervene in the juvenile court case and ask the court to place the children with you, but it's not guaranteed. A court might find it in their interests to be placed in a home which they're more accustomed to. What that means is, if you haven't lived in the same state as your grandchildren for three years, you probably haven't taken care of them much in that time, and your relationship with them is likely to be limited. In particular, if a more familiar environment can be found, that might be preferred. If children are removed from a parent's home in a dependency proceeding, then the law directs a court to prefer relatives for placement, but there could be other factors that would militate in favor of placing them elsewhere. Grandparents have no inherent right to custody of their grandchildren.
